General terms and conditions of the company FoodKreator, valid from 01.08.2008
(Replaces all previous agreements)
1. deliveries
Basically frank Domizil per Camion according to the tour plan. For locations that are not served by Camion, the delivery is by rail. Cable car shipments are charged to the recipient, postal deliveries and additional costs from accelerated forwarding are billed by us. For damages or late deliveries of the post office is not liable. In the absence of the customer or authorized person at the unloading point, no goods are unloaded.
2. Delivery time
From order receipt to delivery, 5 working days are to be included. In peak times delivery delays can not always be avoided. Compensation for late delivery is excluded. For special productions differing delivery times apply.
3. Storage
The goods must be stored after declaration. Herbs and spice mixtures at room temperature (18-22 degrees Celsius) refrigerated products at 4 degrees Celsius and frozen foods below minus 18 degrees Celsius. Frozen products should not be frozen again once thawed. The company FoodKreator can not be held responsible for damages and consequential damages that arise as a result of improper storage and treatment.
4. Small deliveries
If the billing value is less than CHF 50 .--, a small quantity surcharge of CHF 20 .-- will be charged. The small quantity surcharge will not be charged when the goods are picked up.
5. Prices / VAT
The prices quoted are subject to change without VAT and are subject to change without notice (Listed prices are exclusive of VAT)
6. Complaints
Any complaints must be made immediately, but no later than 24 hours after receipt of the goods. In the case of transports by post or train, any damage incurred by the consignee must be reported immediately by post or rail.
7. Payments
All goods are always delivered for cash in Swiss Francs. Deviations from this rule are left to the discretion of the FoodKreator. For deliveries on credit, the invoices are to be paid net in Swiss Francs within 15 days from the invoice date, net of any deductions. For late payments, a default interest of 8% p.a. due. In addition, the corresponding dunning and collection charges will be charged. By placing an order and receiving the corresponding goods, the customer expressly acknowledges these terms of payment.
8. Retention of title
The delivered goods remain the property of FoodKreator until the full payment of the purchase price irrespective of the expiry of the withdrawal period. The customer is obliged to treat the goods carefully until full payment.
9. Deviating from these terms or additional obligations are ineffective without our written consent
10. Severability clause
Should a clause in these Terms and Conditions of Sale and Delivery prove to be invalid for any reason whatsoever, the remaining provisions shall not be affected. In this case, the parties endeavor to replace the invalid clause with a supplement that comes as close as possible to the original intention. The same applies to unintentional gaps in these conditions.
11. Jurisdiction
The present contract is subject to Swiss law. The place of performance and place of jurisdiction for all disputes shall be Lucerne
